Terms and Conditions for Texts and Emails

Introduction These Terms and Conditions apply to all text (SMS/MMS) and email communications, promotions, alerts, confirmations, and other messaging (collectively “Messages”) sent to you by Hanberg Ranches or HPG AG Tri Cities, WA (“Hanberg Ranches,” “HPG AG LLC,” “we,” or “us”). By providing your mobile number and/or email address or by opting in to receive Messages, you agree to these Terms and Conditions.

  1. Consent to Receive Messages

  • By opting in, you expressly consent to receive marketing, informational, and transactional Messages from Hanberg Ranches at the phone number(s) and email address(es) you provide.

  • You confirm that you are the account holder or have permission to enroll the device and/or email address provided.

  • Consent is not a condition of purchase; receiving Messages is optional unless required for a transaction or service you requested.

  1. Types of Messages

  • Marketing Messages: promotions, special offers, product and hay availability, events, and other advertising.

  • Transactional Messages: order confirmations, delivery or pickup notifications, billing notices, and other information necessary to complete a transaction.

  • Informational Messages: updates about services, policy changes, ranch operations, or important notices.

  1. Message Frequency

  • Message frequency may vary based on your preferences and ranch activity. We will make efforts to honor any frequency preferences you select, but cannot guarantee a specific number of Messages.

  1. Message Rates and Carrier Charges

  • Message and data rates may apply. You are responsible for any fees charged by your mobile carrier or email provider. Hanberg Ranches is not responsible for any charges from your carrier.

  1. Opting In and Opting Out

  • Opt-in methods: Customers may opt in by providing consent through our website forms, text keyword opt-ins, paper forms, in-person sign-up, or other methods we provide.

  • Opt-out methods for text Messages: Replying with STOP, or as otherwise instructed in the text Message. After you send the opt-out request, we will send a confirmation Message. After you opt out, you may still receive a final confirmation Message and any Messages required to fulfill a transaction you requested.

  • Opt-out methods for email: Use the unsubscribe link included in the email or follow other unsubscribe instructions in the message. Allow a reasonable time for processing unsubscribe requests.

  • Opt-out requests will be processed promptly; however, you may receive Messages in transit or related to prior transactions before the opt-out takes full effect.

  1. Privacy and Data Use

  • We collect, store, and use contact information and Message interaction data consistent with our Privacy Policy. By consenting to Messages, you authorize us to use your contact information for the purposes described in these Terms.

  • We do not sell your phone number or email address. We may share contact information with service providers and partners only as necessary to deliver Messages and provide related services, and subject to confidentiality obligations.

  1. Message Content and Security

  • We seek to ensure Messages are accurate and secure, but we cannot guarantee uninterrupted delivery or perfect accuracy. Messages may include links, images, and files. Do not provide sensitive personal information in reply to Messages (for example, Social Security numbers, full banking credentials).

  • We are not liable for interception or unauthorized access to Messages after they are sent.

  1. Prohibited Uses

  • You must not use our short codes, reply channels, or email reply addresses for abusive, harassing, illegal, or spamming behavior. We reserve the right to block numbers or addresses that violate acceptable use standards or that we reasonably believe present a risk.

  1. Message Support

  • For help or support regarding Messages, reply HELP to a text Message or follow the support instructions in an email. If those options are unavailable, contact Hanberg Ranches customer service during normal business hours as provided on our materials.

  1. Disclaimers and Limitation of Liability

  • Messages are provided “as is.” To the fullest extent permitted by law, Hanberg Ranches and/or HPG AG LLC disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose, regarding Messages.

  • Hanberg Ranches and/or HPG AG LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from Messages, even if advised of the possibility of such damages. Our total liability for direct damages relating to Messages shall not exceed $100 or the amount you paid to us in the prior six months, whichever is greater, to the extent permitted by applicable law.

  1. Governing Law and Dispute Resolution

  • These Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law provisions.

  • Disputes arising from these Terms shall be resolved in the state or federal courts located in Benton County, Washington.

  1. Changes to Terms

  • We may modify these Terms at any time.
